1. Our Position on Copyright

Woof World, LLC (“Woof World,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of woofworld.com, my.woofworld.com, and related sites and services (collectively, the “Site”) to do the same.

We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and we terminate the accounts of repeat infringers in appropriate circumstances.

This Policy is incorporated into our Terms of Service.

3. Submitting a Notice of Alleged Infringement

To be effective under the DMCA, your notice must be in writing and must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on the owner’s behalf;
  2. Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of those works;
  3. Identification of the material you claim is infringing, with enough detail for us to locate it — for a video entry or community post, include the direct URL;
  4. Your contact information, including your name, mailing address, telephone number, and email address;
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

An incomplete notice may not be effective and may delay our response.

4. What Happens After We Receive a Notice

When we receive a notice that substantially complies with Section 3, we will act expeditiously to remove or disable access to the material identified. We will make reasonable efforts to notify the user who posted it, provide that user with a copy of the notice, and inform them of their right to submit a counter-notification.

If the material is a contest entry, removal may result in disqualification of that entry under our Terms of Service, and may occur at any point in a contest, including after voting has closed.

5. Submitting a Counter-Notification

If your material was removed and you believe the removal was the result of a mistake or misidentification, you may submit a counter-notification to our Copyright Agent. It must include:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and the location where it appeared before removal;
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, mailing address, telephone number, and email address; and
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, the judicial district in which Woof World may be found, and that you will accept service of process from the person who submitted the original notice or that person’s agent.

6. What Happens After a Counter-Notification

We will forward your counter-notification, including your contact information, to the person who submitted the original notice. Your name and address will be disclosed to that person.

If the original complainant does not notify us within ten (10) business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material. Restoration typically occurs between ten and fourteen business days after we forward the counter-notification.

Restoration does not reinstate a disqualified contest entry. Where an entry was removed during an active contest and the contest concluded before the counter-notification process finished, the results of that contest are final.

7. Repeat Infringers

We maintain a record of notices we receive. An account associated with repeated notices of alleged infringement is subject to suspension or termination, and we may terminate an account at any point where the circumstances warrant, regardless of the number of notices received.

Termination for repeat infringement results in forfeiture of contest entries, reward points, and membership benefits as described in the Terms of Service.

8. Misrepresentation

Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Consider consulting an attorney before submitting a notice or a counter-notification.

9. Trademark and Other Complaints

The DMCA process applies to copyright only. For complaints involving trademark, right of publicity, privacy, or other rights, contact legal@woofworld.com with a description of your right, the material at issue, its location on the Site, and your contact information.

10. Content Requirements for Contest Entries and Community Posts

Our Terms of Service require that all content you submit be original or used with all necessary rights. Contest entries are subject to additional restrictions on third-party audio, including a prohibition on commercially released music added during editing. Meeting those requirements is your responsibility, and a takedown notice may result in removal and disqualification regardless of your intent.

11. Changes to This Policy

We may update this Policy. When we do, we will update the version number and effective date above and retain prior versions in an accessible archive.
